INTERNATIONAL SEMINAR DESIGN, INC - TERMS & CONDITIONS
Reservations and Payments:
A completed and signed reservation form must be returned to International Seminar Design, Inc. (ISDI) with a deposit of $750 per person made payable by Visa/Mastercard or by check to International Seminar Design, Inc. to guarantee a space on the tour. ISDI will not provide tickets, coupons, vouchers, final documents, or deviation assistance until full payment has been received by ISDI. ISDI will not accept responsibility for wire transfer and/or overnight mail charges in the collection of overdue fees.
Program Does Not Include:
Airline tickets, airline taxes, or fuel surcharges; airport porterage; transfers to and from the airport; gratuities for hotel cleaning staff; personal items such as wines, liquors, à-la-carte orders, meals other than those specified in the itinerary, personal services, room service, valet/laundry service, and tour deviations. If due to weather, flight schedules, or other uncontrollable factors, you are required to spend any additional nights, you will be responsible for your own hotel, transfer, and meal costs. Personal insurance for health, baggage, and tour cancellation is not included. Tour cancellation/Interruption Insurance is strongly recommended. Travel insurance forms will be supplied to registrants by ISDI.
Cancellations & Refunds:
ISDI reserves the right to cancel the tour prior to departure for any reason including insufficient numbers of participants. ISDI reserves the right to decline to accept or retain any person as a member of the tour at any time. If bookings fall below the minimum required, passengers will be advised of additional costs or itinerary alterations before departure date. All cancellations must be received in writing by the participant(s) and shall only be effective upon its acknowledged receipt by ISDI. Cancellation charges are calculated as of the day notification is received in writing by ISDI.
If a tour member cancels, the following scale of charges is incurred: There is a non-refundable administrative fee of $500 per person. The costs associated with any tickets purchased for planned activities (as indicated in the itinerary) are non-refundable. No refunds for any unused portion of the tour including, but not limited to, occasional missed meals or any missed sightseeing tours. Costs for promotion, staff, and other group expenses are not refundable. In the case of cancellation, substitutions are not acceptable. The tour cost is non-transferable.
No refunds are given: (1) for lost travel time or substitution of facilities, (2) for itineraries amended after departure, (3) for circumstances beyond ISDI’s control, necessitating alternate arrangements being made to ensure the safety and/or further participation and enjoyment of your program, (4) if you leave the program after it has begun or miss any scheduled sightseeing, activities, meals, or accommodations. A package of cancellation, baggage, and medical insurance is strongly recommended. An insurance application will be included with your tour confirmation letter. This package is for insurance in case of cancellation and may cover the non-refundable expenses incurred.
If the program is cancelled by ISDI, active registrants will receive a full refund of all tour payments.
ISDI is willing to assist with special air or land arrangements; however, deviations and pre- and post-tour arrangements will be priced and billed separately. Before ISDI can assist with any deviation, full balance for basic tour must be received. A $100 per person administrative fee will be charged for processing special land arrangements. Individual air carriers charge deviation fees; any deviations in-group air arrangements may incur an additional fee from the carrier.
Frequent Flier Miles:
Participants planning on using Frequent Flier mileage must make arrangements directly with the airlines. Participants are responsible for ensuring that they obtain Frequent Flier mileage for flights where applicable. ISDI is not responsible for securing Frequent Flier mileage.
For Your Information:
ISDI acts as a booking agent for hotels, airlines, bus companies, ground transportation, boat purveyors, and other independent contractors providing accommodations, transportation, and/or other services abroad. Each of these companies is an independent corporation with its own management and is not subject to the control of ISDI, including but not limited to, various overseas operators. All bookings like those described above are accepted by ISDI, as agent for independent overseas ground operators and independent suppliers. The transportation, accommodations, and other services provided by the ground operators/suppliers are subject to the terms and conditions contained in the tickets, contracts, exchange orders, or vouchers issued by them and/or their suppliers. Because ISDI does not have the right to control the operations of the independent operators and suppliers, ISDI cannot be liable for any personal injury or property damage that may arise out of these services. ISDI reserves the right to cancel any itinerary or any part of it, to make such alteration to the itinerary as it deems necessary or desirable, to refuse to accept or to retain as a member of any program any person at any time, and to pass on to tour participants any expenditure occasioned by delays or events beyond its control.
Carriage by Land and Air is subject to the terms and conditions of the carrier with whom you travel, some of which may limit liability. Land, Sea, and Air travel also are subject to operational decisions of carriers and air and sea ports which may result in cancellations, delays, or diversions, over which ISDI has no control and for which ISDI accepts no liability whatsoever.
Temporary or permanent loss of baggage is the responsibility of you or the carrier.
ISDI draws your attention to the fact that there are certain inherent risks involved in participating in cultural tours and that you accept them at your own risk. It is your sole responsibility to take all appropriate medical advice prior to departure as to whether or not you are fit enough to undertake a tour. ISDI shall not be liable for illness, injury, or death sustained on a tour sold by ISDI that is not due to the gross negligence of ISDI, its officers, employees, authorized representatives, or agents whomsoever.
“Force Majeure” means in relation to ISDI, any circumstances beyond the reasonable control of ISDI (including but without limitation, acts of god, explosion, flood, tempest, fire or accident, war or threat of war, sabotage, terrorism, insurrection, civil disturbance, or requisition, sickness, quarantine, government intervention, weather conditions, or other untoward occurrences). If ISDI is affected by Force Majeure, it shall forthwith notify you of the nature and extent thereof. ISDI shall not be deemed to be in breach of these terms and conditions or otherwise liable to you, by reason of delay in performance, or any of its obligations hereunder to the extent that any such delay or non-performance is due to any force majeure. If Force Majeure affects ISDI, it shall be entitled to, and may in its sole and absolute discretion, vary or cancel any itinerary or arrangement in relation to the trip. Payment of any refund by ISDI to you as a result of the non-performance of any of ISDI’s obligations hereunder shall remain in its sole and absolute discretion although ISDI shall use its reasonable endeavors to reimburse you where possible. However, ISDI shall be entitled to deduct from any refund recoverable the reasonable actual and potential costs to ISDI of the Force Majeure. Regarding civil unrest, once ISDI has investigated the prevailing situation as it deems fit, it shall remain in ISDI’s sole and absolute discretion whether to proceed with the trip. You may in such circumstances cancel the trip. However, if after having made all reasonable and proper inquiries, ISDI is of the opinion that the trip may proceed, no refund will be payable to you and the provisions of the cancellation charges described earlier shall apply.
ISDI endeavors to provide the latest health information on the mandatory health requirements for ISDI destinations, but will not assume responsibility for the accuracy of this information. You are strongly encouraged to consult with your personal physicians or a specialist travel clinic about any necessary precautions prior to departure.
Air Carriers’ Contract:
ISDI does not accept liability for any airline cancellation penalty incurred by the purchase of any nonrefundable ticket (s) purchased in conjunction with the tour. The airlines concerned are not to be held responsible for any act, omission, or event during the time tour members are not on board their aircraft or conveyance. The passage contract in use by the airline concerned, when issued, shall constitute the sole contract between the airlines and the purchaser of these tickets, and/or the passenger. Please note, if participant cancels, participant is subject to terms of the contract between the airlines and the purchaser of these tickets.
Although ISDI hopes that it will not need to levy surcharges (such as a raise in city taxes on hotels) it reserves the right to do so on the invoice amount, if this becomes necessary. ISDI will endeavor to notify you in writing as soon as it is aware of any likely surcharge, and you must pay the amount of the surcharge no later than 14 days after written notification has been received (depending upon the circumstances). If the surcharge is not paid within such time, ISDI may construe such nonpayment as an act of cancellation on your part and the cancellation charges described earlier will apply. Any refund made by ISDI shall be at its sole and absolute discretion.
Travel Documents and Vaccinations:
It is your responsibility to ensure passports, visas (unless ISDI provides this service), travel permits, health certificates, inoculations, or other documentation required for the tour are obtained and are in order. It is your responsibility to meet with such requirements.
You must advise ISDI in writing of any special requests e.g. diet (vegetarian or allergies), facility, or physical handicap, when you submit your Personal Information Form (provided by ISDI upon registration) to ISDI. ISDI will meet such requests, if possible.
If you have cause for complaint while traveling, you must immediately bring it to the attention of the escorting ISDI tour manager, or ISDI representative or agent, who will attempt to resolve the situation.
The payment of the deposit constitutes consent to all provisions of the conditions and general information contained in this brochure. The terms under which you agree to take this tour cannot be changed or amended except in writing signed by an authorized officer of ISDI.
Condition Of Booking:
You shall comply with the instructions of ISDI’s representatives at all times. No client shall be accepted or be permitted to continue on a tour while their status of mental or physical condition is in the opinion of any ISDI representative such as to render them incapable of caring for themselves or make themselves objectionable to other participants or become a hazard to themselves or other participants, and ISDI will not be responsible for expenses by such persons precluded from completing the program for this reason.
Notice of Enforceability:
These Terms and Conditions govern the relationship between ISDI and you, to the total exclusion of any other terms and conditions. No alteration to the terms and conditions may be made by any ISDI employees, authorized representatives, or agents unless in writing by an authorized officer of ISDI. An authorized officer of ISDI shall make all decisions and matters subject to ISDI’s discretion. Please remember: When you book travel-related services with ISDI, you are entering into a binding agreement that assumes all terms and conditions are fully understood as stated in this document.
International Seminar Design, Inc. (“ISDI”) acts as the agent for the suppliers of services (including, but not limited to, air and ground transportation, meals, and lodging) provided in conjunction with the tour. ISDI is not liable for the negligent acts, omissions, defaults, or failure to perform of such suppliers. The Participant releases ISDI from any and all liability resulting from acts or omissions of the suppliers of services, including, but not limited to, loss, damage, delay or injury, or damage to Participant (including death) or Participant's personal property. Nor does ISDI accept responsibility for losses or delays arising from sickness, quarantine, government restraints, war, acts of terrorism, weather conditions, earthquakes, or acts of God. In no event shall ISDI’s liability exceed the amount received by ISDI from Participant. ISDI has no special knowledge of problems or hazards regarding health or safety in the destinations visited by Participant. Participant agrees to assume full responsibility for his/her safety during this tour and is advised that some destinations visited may involve risks of political instability, terrorism, social unrest, disease, and climatic extremes, as well as geographical and atmospheric extremes such as altitude and/or pollution, earthquakes, etc. Participant assumes all risks of damage or injury in connection with such risks and agrees to indemnify and hold harmless ISDI against any and all claims arising from Participant's travel to such destinations. For additional information regarding hazards in specific destinations, Participant may consult the U.S. State Department and the Center for Disease Control. Dates, schedules, program details, and costs stated by ISDI’s itinerary and brochure are given on good faith and based on information available at the time of publication of the brochure and of pricing the tour and are subject to change and revision at any time by ISDI. ISDI does not guarantee the rates of any suppliers and reserve the right to substitute alternate suppliers if deemed necessary by ISDI. ISDI reserves the right to change Participant's itinerary if, in ISDI’s sole discretion, such change is advisable to protect Participant’s safety. No refund shall be due from ISDI in conjunction with changes in rates or itineraries, substitution of suppliers, or Participant’s decision not to complete a tour itinerary. ISDI reserves the right to refuse to accept any Participant, cancel any tour at any time, or request a Participant to withdraw from a tour if, in ISDI's sole discretion, such refusal, cancellation, and/or withdrawal are in the best interest of Participant or other tour Participants. Participants are encouraged not to purchase airline tickets until after receiving a letter stating that they are confirmed on the tour, and ISDI does not accept liability for any airline cancellation penalty incurred by the purchase of a non-refundable domestic ticket to the tour departure cities and return. Baggage and personal effects are the sole responsibility of the owners at all times.
